Duffy & Duffy Lawyer Reacts: Triple Car Crash at Intersection

Okay, first couple things we want to take a note for. You're entering into intersection where the light is turning from a yellow to red. At the time the light turns red, we can see that the blue car has already been halfway into the intersection. They are in the right of way to pursue straight through the intersection and have no fault. Now, the black car making the right turn has to yield to the blue cars right away, failing to do so. [snorts] Another thing we have to make sure we note here is that the blue car tries to avoid the accident, but they still have a duty even when seeing cars in front of them to avoid any happening of the accident. If I'm this driver sitting there waiting to make a left turn and a car comes and flips over on top of me, I think in this situation I sue both. The black car had a responsibility to yield to the blue cars right away and failed to do so. But the blue car failed to make sure that the area was safe and avoided the happening of the accident.
