The firm
Refer a Case
For attorneys with a medical malpractice or serious injury matter to refer or co-counsel.
Duffy & Duffy accepts referrals and co-counsel arrangements from other attorneys in medical malpractice, birth injury, nursing home and serious personal injury matters in New York. We try cases. Referring counsel stays informed and involved as needed.
How to refer a case
Call (516) 394-4200 and say you are an attorney referring a matter, or use the contact page and note that in the message. A partner will call you back to talk through the facts, the timeline and the arrangement. Fee-sharing arrangements follow New York Rule of Professional Conduct 1.5(g) and are put in writing with the client's consent.
What to have ready
The client's name and contact details, the dates and the place involved, whether a hospital, nursing home, or the scene of an accident, any records you already hold, and the date the client first contacted you. Deadlines in New York injury cases are short, and the first question we will ask is when it happened.

Frequently asked questions
Do you pay referral fees, and how are they set?
Yes, where the rules allow it. Fee-sharing between lawyers in New York follows Rule of Professional Conduct 1.5(g): the arrangement is put in writing, the client consents to it in writing, and the division is either in proportion to the work each firm does or made with both firms taking joint responsibility for the matter. We talk through the arrangement on the first call, before anyone commits.
What kinds of cases do you take on referral?
Medical malpractice, birth injury, nursing home abuse and neglect, and serious personal injury and wrongful death matters in New York. These are the cases we try. A matter outside those areas is one we would rather help you place with the right firm than take on; see our referral program.
What happens to my relationship with the client?
You keep it. Referring counsel stays informed as the case moves and involved as needed. The client hears from you as well as from us, and nothing about the referral is hidden from them.
How quickly will someone get back to me, and what should I have ready?
A partner returns the call, not an intake screener. Have the client's name and contact details, the dates and the place involved, whether a hospital, nursing home, or the scene of an accident, any records you already hold, and the date the client first contacted you. Deadlines in New York injury cases are short, and shorter still when a public facility is involved, so the first thing we will ask is when it happened.
Do you refer cases out as well?
We do. Our phone rings with matters outside our practice, and our goal is to send those people to the right firm. If your firm's strengths are ones we do not have, we would like to know you; the referral program page explains how that works and how to get the firm's brochure for your own clients.
