The “Scaffolding Law” – New York Labor Law 240

In New York, Section 240 of the New York Labor Law covers the use of scaffolding, ladders, hoists, slings, blocks, braces and other equipment by employees.  The law requires contractors, owners and their agents (with limited exceptions), in the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure, to provide scaffolding, hoists, stays, ladders, slings, hangers, blocks, pulleys, braces, irons, ropes, and other devices to give proper protection to the construction workers.

The law imposes strict liability, meaning those injured on scaffolding, even if negligent, can recover for the injuries suffered or for loss of life.  Unless the injured party is the sole and proximate cause of his or her scaffolding injuries, the worker can still recover under the Scaffolding Law.
