In this case, the client was born extremely premature at 23 weeks gestation after physicians failed to provide appropriate prenatal care despite the mother’s well-documented history of an incompetent cervix. The jury found that Jacobi Medical Center departed from accepted standards of care by failing to provide a prophylactic cerclage, failing to conduct serial transvaginal ultrasounds, and failing to perform a timely rescue cerclage. As a result, the child suffered catastrophic, life-altering injuries, including cerebral palsy, chronic lung disease, profound intellectual disability, and global developmental delays.
After hearing extensive testimony, the jury held the NYC Health & Hospitals Corporation fully accountable, exonerating St. Barnabas Hospital and its physicians, and finding Jacobi Medical Center solely responsible for the injuries sustained.
