This case involves a child who suffered a brachial plexus injury/right Erb’s palsy because of a traumatic birth. The infant weighed 10 lbs., 1 oz. and was the product of a pregnancy complicated by gestational diabetes. Plaintiff claimed that the defendant obstetrician failed to properly manage the obstetrical mother’s diabetes, leading to excessive growth in the fetus, failed to be aware of the large size of the fetus and should have given the mother the option to deliver by Cesarean section. In addition to the $1,400,000 cash settlement, the infant plaintiff has been enrolled in the New York State Medical Indemnity Fund and all of her future medical expenses will be covered by the Fund.
