The 50 year old husband and father presented to the hospital with significant chest and back pain. Despite performing diagnostic tests, the defendants failed to diagnose an aortic aneurism in the area of his kidneys. Once the plaintiff’s first round of tests did not offer an explanation for his symptoms, the defendant’s obligation was to continue to investigate until a cause was determined. Here, defendants did not continue that investigation-instead making a “catch all” diagnosis with an unknown cause. Ultimately, the plaintiff suffered the loss of a large portion of his bowel and a loss of function of his immune system due to bowel loss. The plaintiff died from his body’s inability to fight off infection. Duffy & Duffy settled this claim for $4,000,000.00.
