Prenatal Negligence

Duffy & Duffy secured a $6.6 million settlement on behalf of a female plaintiff when physicians failed to take her family’s history of disease into account during her pregnancy. The plaintiff’s medical history showed that her unborn baby had a one in four chance of being born with a rare metabolic disease. This disease could have been prevented with the proper prenatal tests, and could also have been treated had postnatal tests been conducted.

Duffy & Duffy proved that even after the baby displayed numerous symptoms suggestive of the disease, the physicians failed to test for it. As a result, the baby suffered from brain damage, cerebral palsy and seizures.
