Throughout New York, companies use scaffolding in the construction of buildings both large and small.  Unfortunately, if you have reached this page, you or a family member was likely injured or killed in a scaffolding accident.

As you know, scaffolding structures can be extremely dangerous, as they are often assembled and disassembled very quickly, may be poorly constructed and pose risks to construction workers.  Even when properly assembled, scaffolding is extremely dangerous and puts construction workers at risk every day.

Sadly, most injuries are quite serious and are often fatal.  Falls of any sort can cause injury, and falls from five stories, ten stories and higher can be deadly.

The “Scaffolding Law” – New York Labor Law 240

In New York, Section 240 of the New York Labor Law covers the use of scaffolding, ladders, hoists, slings, blocks, braces and other equipment by employees.  The law requires contractors, owners and their agents (with limited exceptions), in the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure, to provide scaffolding, hoists, stays, ladders, slings, hangers, blocks, pulleys, braces, irons, ropes, and other devices to give proper protection to the construction workers.

The law imposes strict liability, meaning those injured on scaffolding, even if negligent, can recover for the injuries suffered or for loss of life.  Unless the injured party is the sole and proximate cause of his or her scaffolding injuries, the worker can still recover under the Scaffolding Law.

What Causes Scaffolding to Collapse

While safety should be the highest priority for any construction site, the reality is that mistakes happen.  When scaffolding is used past its useful life, was assembled carelessly or was not inspected, injuries can occur.  Even when properly assembled, scaffolding is extremely dangerous.  Scaffolding accidents and collapses can occur when:

  • Scaffolding is not properly braced and shifts, leans or otherwise behaves in the incorrect manner.
  • Construction of the scaffolding was done carelessly;
  • The scaffolding is assembled with damaged or worn parts;
  • Components, such as fasteners, are missing or were not installed;
  • Scaffolding is not properly maintained once erected;
  • Scaffolding is overloaded past its capacity; or
  • Scaffolding equipment is not provided or is inadequate.

Examples of scaffolding injuries include:

  • Death;
  • Paralysis;
  • Brain Damage;
  • Concussions;
  • Knee and leg injuries;
  • Back and neck injuries;
  • Injuries to arms, elbows and hands;
  • and more.
